Refund & Cancellation Policy

Our policies regarding refunds and cancellations for donations.

At Sobera Foundation, we value the trust and support of every donor. Contributions received by the Foundation are intended to support charitable, humanitarian, animal welfare, community welfare, and other activities carried out in accordance with the Foundation's stated charitable objectives. Donors are requested to carefully verify the donation amount, payment details, and other information before completing a transaction. 1. General Donation Policy All donations made to Sobera Foundation are voluntary contributions. Once a donation has been successfully processed and received, it is generally non-refundable and non-cancellable, except where a refund, reversal, correction, or cancellation is required or permitted under applicable law, applicable payment-system rules, or the circumstances specifically described in this Policy. Donations may be utilised or allocated towards the Foundation's charitable activities and programmes. Accordingly, a donor does not have an automatic right to cancel or demand a refund of a successfully completed donation merely because they have subsequently changed their mind. 2. Incorrect, Duplicate or Failed Transactions A donor may contact Sobera Foundation if: - the same donation was debited more than once; - an incorrect amount was debited; - a transaction failed but the donor's account was nevertheless debited; - a technical error occurred during the payment process; - a payment was made through an incorrect transaction due to a genuine technical issue; or - any other genuine payment-related discrepancy occurred. The Foundation may verify the transaction with the relevant payment gateway, bank, card issuer, UPI service provider, or other payment service provider. Where a refund, reversal, correction, or other resolution is appropriate, the Foundation may take the necessary steps in accordance with applicable law and the applicable procedures of the relevant payment service provider. 3. Unauthorised Transactions If a donor believes that a donation or payment was made without their authorisation, the donor should notify Sobera Foundation as soon as reasonably possible. The donor should also contact their bank, card issuer, UPI provider, or other relevant payment service provider where appropriate. The Foundation may request reasonable information and supporting documents for the purpose of verifying the transaction. Any refund, reversal, or other action relating to an alleged unauthorised transaction will be subject to verification and the applicable rules and procedures of the relevant financial institution or payment service provider. 4. Refund Requests Refund requests should be submitted as soon as reasonably possible after the relevant transaction. For verification, the donor may be required to provide: - Full name; - Registered email address or mobile number; - Date of transaction; - Donation amount; - Transaction ID / UTR / Payment Reference Number; - Payment method; - Reason for the refund request; and - Any other information reasonably necessary to verify the transaction. Submission of a refund request does not by itself constitute approval of the refund. Each request will be reviewed individually based on the circumstances of the transaction, applicable law, payment-gateway procedures, and the Foundation's internal financial controls. 5. Approval and Processing of Refunds Where a refund is approved, Sobera Foundation will, wherever reasonably possible, process the refund through the original payment method or the relevant payment gateway. The time required for the refunded amount to be credited to the donor may depend on the bank, payment gateway, card issuer, UPI provider, payment network, or other financial institution. Sobera Foundation will not be responsible for delays caused by third-party financial institutions or payment service providers that are outside the Foundation's reasonable control. 6. Recurring or Scheduled Donations Where recurring or scheduled donations are available, a donor may request cancellation of future payments through the applicable recurring-payment mechanism or by contacting Sobera Foundation through the contact information published on the official website. Cancellation of a recurring donation will normally apply only to future payments. Cancellation of future payments does not automatically entitle the donor to a refund of donations that have already been successfully processed. 7. Donation Receipts and Tax Benefits Where applicable, Sobera Foundation will issue donation receipts and provide other required documentation in accordance with applicable laws and regulatory requirements. Donors are responsible for providing accurate and complete information required for the issuance of donation receipts or other applicable documents. Any tax deduction or tax benefit associated with a donation will depend upon the donor's eligibility and the applicable provisions of Indian tax laws. Where applicable, the Foundation will comply with statutory requirements relating to donation reporting and the issuance of relevant donation certificates or statements. Where the Foundation is eligible and approved under the applicable provisions of Section 80G of the Income-tax Act, it will comply with the applicable requirements relating to donation reporting and certificates. The Income Tax Department requires specified 80G-approved institutions to furnish donation statements and issue the prescribed donation certificates where applicable. 8. No Guarantee of Tax Deduction The availability of any tax deduction or tax benefit is subject to applicable law and the donor's individual eligibility. Sobera Foundation does not guarantee that any particular donor will be entitled to a tax deduction or tax benefit merely because a donation has been made. Donors should consult their tax advisor or a qualified professional regarding their individual tax position, where necessary. 9. Exceptional Circumstances Sobera Foundation recognises that genuine and exceptional circumstances may arise in connection with a donation transaction. The Foundation will consider genuine requests fairly and in good faith, taking into account: - applicable laws and regulations; - payment-system and banking requirements; - transaction verification; - the circumstances of the request; - the Foundation's charitable obligations; and - applicable internal financial controls. Approval of a refund or correction in one case does not create an automatic right to a refund or correction in another case involving different circumstances. 10. Compliance with Applicable Laws Nothing in this Policy is intended to exclude, restrict, or override any right, remedy, obligation, requirement, or protection that cannot lawfully be excluded or restricted under applicable law. In the event of any conflict between this Policy and a mandatory requirement of applicable law, the applicable law shall prevail. 11. Changes to this Policy Sobera Foundation may update or amend this Refund & Cancellation Policy from time to time to reflect changes in applicable laws, regulations, payment systems, regulatory requirements, or the Foundation's operational procedures. The updated version will be published on the official website and will indicate the revised effective date. 12.
